Terms of Service & Cancellation Policy

Welcome to 33gibor (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (33gibor.ai), client portal, digital ecosystems, software platforms, CRM automation, digital phone systems, AI tools, and subscription services (collectively, the “Services”). By creating an account, checking the acceptance box at checkout, or using any of our Services, you agree to be legally bound by these Terms.

1. Scope of Services

33gibor provides integrated digital business solutions offered as recurring subscription packages, including but not limited to:

• Local Pro, ProMax & Social Plus: Professional web design, managed cloud hosting, SSL security, on-page and local SEO, Google Business optimization, and social media brand management.
• CRM Auto & AI Receptionist: Customer Relationship Management (CRM) workspaces, sales pipelines, automated follow-up workflows, unified inbox, digital business phone numbers, and AI-powered voice and chat receptionists.

Exact deliverables and feature tiers depend on the active subscription plan selected on our Services & Pricing page.

2. Account Registration & Security

To subscribe to our Services, you must register for an account and provide accurate, current, and complete information (including your full legal name, business name, valid email address, and telephone number). You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscription Billing & Automatic Renewal (ROSCA Disclosure)

In compliance with the U.S. Restore Online Shoppers’ Confidence Act (ROSCA) and the Federal Trade Commission (FTC) Negative Option Rule:

• Advance Recurring Billing: All subscription plans are billed in advance on a recurring basis according to the billing cycle you select at checkout: either Monthly (billed every month) or Annual (billed once every 12 months at a 25% discount compared to monthly billing).
• Continuous Auto-Renewal: Your subscription will automatically renew at the end of each paid billing period (monthly or annually) for an equivalent period at the then-current subscription rate unless you cancel your subscription before your next scheduled billing date.
• Payment Authorization: By providing a payment method through our payment processor (Stripe, Inc.) and accepting these Terms at checkout, you authorize 33gibor and Stripe to charge your designated payment method for all recurring subscription fees, applicable one-time setup fees, and any applicable taxes.

4. One-Time Setup Fees (Strictly Non-Refundable)

Certain subscription plans include a One-Time Setup Fee charged on your initial invoice. This fee covers immediate onboarding labor, server allocation, domain/DNS configuration, CRM workspace provisioning, and custom workflow setup. All One-Time Setup Fees are strictly non-refundable under all circumstances once payment is processed.

5. Cancellation & No-Refund Policy

Please read our cancellation and refund terms carefully before purchasing a Monthly or Annual subscription:

• Easy Self-Service Cancellation: You may cancel your subscription at any time with zero cancellation penalties or termination fees directly through your Client Portal Dashboard (by clicking Cancel Subscription or Manage Billing) or by emailing support@33gibor.ai.
• Access Until End of Paid Term (Grace Period): When you cancel a subscription, automatic renewal is immediately turned off and you will not be charged again. Your account will remain active and you will retain full access to your Services through the last day of your current paid billing cycle (the remainder of your paid month for Monthly plans, or the remainder of your paid 12-month period for Annual plans).
• No Refunds for Partial Months or Unused Annual Time: Because infrastructure, software licenses, and annual discount rates (25% off) are committed upfront upon purchase, all subscription payments are final and non-refundable. 33gibor does not issue full or partial refunds, prorated credits, or reimbursements for partially used months, unused months remaining on an Annual subscription, or periods of account inactivity.
• Resuming a Canceled Subscription: If you cancel your subscription, you may reactivate (resume) it at any time from your Client Portal prior to the expiration of your current paid period without losing your workspace configuration.

6. Failed Payments, Past-Due Accounts & Disputes

• Failed Charges: If an automatic renewal charge fails, Stripe will automatically retry the payment method on file and notify you by email. If an account remains past due, access to websites, CRM workspaces, phone numbers, and AI tools may be temporarily suspended until the balance is settled.
• Billing Inquiries & Chargebacks: If you believe an error has occurred on your invoice, you agree to contact support@33gibor.ai first and allow us 7 business days to review and resolve the issue before filing a dispute or chargeback with your bank or card issuer. Your electronic timestamped acceptance of these Terms at checkout serves as binding proof of authorization for all disclosed recurring and setup charges.

7. CRM Provisioning & Third-Party Integrations

Upon completing checkout, our team provisions your dedicated digital workspace (which typically completes within 24 hours). Certain features rely on third-party infrastructure providers (including Stripe for payment processing, GoHighLevel for CRM/automation infrastructure, and telecom carriers for business phone/SMS routing). You agree to comply with all applicable telecom and anti-spam regulations (including the U.S. TCPA, CAN-SPAM Act, and A2P 10DLC carrier rules) when sending messages or placing calls through your workspace.

8. Acceptable Use Policy

You agree not to use the Services for any unlawful, fraudulent, deceptive, defamatory, or abusive purpose; to transmit unsolicited bulk spam; to infringe upon third-party intellectual property rights; or to attempt unauthorized access to 33gibor systems.

9. Limitation of Liability & Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” 33gibor does not guarantee specific revenue, search engine rankings, or lead conversion volumes. In no event shall 33gibor’s total cumulative liability exceed the total amount paid by you to 33gibor in the three (3) months immediately preceding the event giving rise to the claim.

10. Modifications to Terms

We may update these Terms from time to time to reflect operational, legal, or regulatory changes. We will notify active subscribers via email or dashboard notice prior to any material changes taking effect.
